1. Surplus Equipment Disclosure & Product Status

Prestige Surplus, a division of Prestige Operations LLC, is an independent industrial liquidation, equipment brokerage, and surplus supplier. Unless explicitly stated otherwise in writing, all equipment sold through this website or by invoice may be:

• Used, surplus, overstock, or previously installed
• Refurbished, remanufactured, or partially restored
• Removed or recovered from active industrial service
• Obtained through liquidation, decommissioning, or facility cleanouts

All descriptions, photographs, data sheets, specifications, and titles are provided strictly for basic identification purposes and may not include complete condition details.

2. AS-IS / WHERE-IS Sale & Buyer Inspection

All items are sold strictly AS-IS / WHERE-IS with no guarantee of:

• Operational performance, accuracy, or rating integrity
• Compatibility with the buyer’s systems or intended use
• Completeness of accessories or internal components
• Safety certifications, testing documentation, or traceability

The buyer is fully responsible for verifying suitability, completeness, and safe installation of all equipment prior to commissioning or energizing.

3. Warranty Exclusion

Prestige Operations LLC / Prestige Surplus provides no warranties of any kind, express or implied, including but not limited to:

• Manufacturer warranty coverage
• Merchantability
• Fitness for a particular purpose
• Expected lifespan, run time, or performance reliability

Unless written and signed documentation is supplied at the time of purchase, equipment should be considered untested and without certification.

4. Buyer Responsibilities

The buyer acknowledges and agrees that:

• Equipment may contain wear, cosmetic imperfections, or internal defects
• It is the buyer’s responsibility to ensure code compliance and regulatory standards
• The buyer assumes all risks associated with installation, use, and handling
• Prestige Operations LLC / Prestige Surplus is not liable for improper installation, misuse, or system integration failures

5. No Returns, Refunds, or Exchanges

All sales are final. No returns, refunds, cancellations, or exchanges are permitted unless authorized in a written agreement signed by an authorized representative of Prestige Operations LLC.

6. Testing, Documentation & Additional Services

Testing, certification, diagnostic evaluation, or refurbishing may be available for additional fees. Testing does not guarantee performance beyond the scope of the tests performed and results are provided as-is.

7. Non-Affiliation & Trademark Notice

Prestige Surplus, a division of Prestige Operations LLC, is not an authorized dealer, agent, or representative of any manufacturer. All brand names, logos, and model numbers appearing on this site belong to their respective owners.

8. Limitation of Liability

Prestige Operations LLC (including its division Prestige Surplus) is not responsible for:

• Production losses, downtime, or business interruption
• Labor, removal, installation, or engineering costs
• Indirect, consequential, incidental, or punitive damages
• Personal injury or property damage related to use or installation

The buyer agrees that maximum liability of Prestige Operations LLC / Prestige Surplus shall not exceed the purchase price of the item sold.

9. Shipping, Freight & Delivery Terms

Shipping, freight, rigging, and handling charges are not included unless explicitly stated. Responsibility transfers to the buyer upon carrier pickup. Freight damage claims must be filed directly with the carrier.

10. Acceptance of Terms & Governing Law

By purchasing equipment from Prestige Operations LLC, including its division Prestige Surplus, whether online, by invoice, or in person, the buyer acknowledges acceptance of these Terms & Conditions.

These terms are governed by the laws of the Commonwealth of Pennsylvania under applicable U.S. commercial statutes.

11. Corporate Entity

All brokerage, resale, liquidation, and cleanout activities are conducted under Prestige Operations LLC, which holds all legal liability and protection associated with such transactions. Prestige Surplus operates as a trade name and division of Prestige Operations LLC.
